N.J.S.A. 2C:12-1a Simple Assault
Simple assault is enumerated in N.J.S.A. 2C:12-1a. The statute states:
a. Simple assault. A person is guilty of assault if he:
(1) Attempts to cause or purposely, knowingly or recklessly causes bodily injury to another; or
(2) Negligently causes bodily injury to another with a deadly weapon; or
(3) Attempts by physical menace to put another in fear of imminent serious bodily injury.
Simple assault is a disorderly persons offense unless committed in a fight or scuffle entered into by mutual consent, in which case it is a petty disorderly persons offense.
Penalties for Simple Assault
Simple assault carries with it several penalties. A person found guilty of simple assault may be ordered to pay a fine of at least $1,000, complete probation, pays restitution, or go to jail for up to 6 months.
It is important to note that law enforcement workers, employees of utility companies, and certain health care workers receive special protection from the crime of assault. If simple assault is carried out against one of these individuals, the assault may be elevated to an “aggravated assault” in which case the penalties will be increased.
